This Mailbox Service Agreement ("Agreement") is made and entered into by the customer identified above ("Customer") for the use of and services related to a mailbox (the "mailbox") at The Mail Box Store of New Castle doing business as The Mail Box Store of New Castle, hereinafter referred to as (“The Mail Box Store of New Castle”) under the terms set forth herein and governed by the laws of the State of Delaware.

1. Contract: By signing this Agreement, presenting two acceptable forms of Identification as specified in USPS Form 1583, and completing United States Postal Services Form 1583 ("Form 1583"), a copy of which will be made available by Mail Service to the United States Postal Service (USPS), Customer appoints The Mail Box Store of New Castle as an agent for the receipt of mail during the term identified above, and not to exceed the period for which rent has been paid in advance. Customer is expected to check mail at least once each week or make other suitable arrangements, in advance, with The Mail Box Store of New Castle.

2. USPS Forms: Customer agrees to provide such information as may be necessary to complete required USPS forms, including furnishing acceptable identification. Customer understands that copies of these forms will be furnished to local USPS officials and The Mail Box Store of New Castle will keep copies of identification on file. The Customer understands that The Mail Box Store of New Castle has no authority to accept mail on their behalf until the completed Form 1583 is received, as the authority to receive mail is granted by the US Postal service, and therefore is not responsible or liable for any mail or packages that are delivered by USPS prior to execution of Form 1583 and submission of the appropriate forms of ID for each individual who is to receive mail. Mail for non-compliant individuals, without the required documentation completed with The Mail Box Store of New Castle will be marked as “Undeliverable” per US Postal Service Regulations and returned to sender.

3. Identification: Per USPS regulations, Customer’s Photo and Address identification must be current and not expired. Customer is required to provide updated Photo Identification if the ID has expired during the mailbox term. Customer is further required to notify The Mail Box Store of New Castle of any changes in permanent address and provide updated Address Identification. It is also the responsibility of the Customer to ensure Customer contact information stays up to date for communication purposes.

4. Compliance: Upon request, the customer agrees to complete all necessary documents, including Form 1583 and any required acknowledgment form relating to the service of the process. The customer further agrees to sign an updated version of this agreement, Form 1583 and provide new copies of unexpired valid forms of identification upon request. Request for updated documentation will be provided to the customer in writing and/or delivered to the Customer via email or by placing the request in the Customers assigned PMB. Failure to promptly supply requested information may result in cancellation of services without notices, refund or mail forwarding.

5. Lawful Use: Customer agrees that the customer nor any authorized recipients will not use the PMB, The Mail Box Store of New Castle premises or any The Mail Box Store of New Castle services for any unlawful, illegitimate, or fraudulent purpose or any purpose prohibited by U.S. Postal regulations. The customer further agrees that any use of the mailbox shall conform with this agreement and all applicable federal, state, and local laws, statues, and regulations. Failure to do so may result in cancellation of services without notice. The Mail Box Store of New Castle will cooperate fully with the appropriate law enforcement officials.

6. Accountable Mail: Per USPS regulations, The Mail Box Store of New Castle will accept any type of properly addressed mail for registered recipients including on behalf of Customer once Form 1583 has been executed. Acceptable mail includes but is not limited to any certified, registered, insured, restricted, or C.O.D. mail or parcels. Full payment of any C.O.D. charges must be paid to Mail Service prior to acceptance of C.O. D. packages. The Mail Box Store of New Castle reserves the right to open and inspect any packages or mail which may arrive damaged or that may be otherwise of questionable integrity or legality.

7. Properly Addressed: The address to be used by the Customer for the purpose of receiving mail must conform to USPS DMM regulation. Customer shall use only the address designation “PMB” or “#” to designate their address. NO OTHER DESIGNATION IS VALID. Specifically excluded is the use of Suite, Apt, Dept or other designators. The U.S. Postal Service may refuse to deliver any piece of mail that does not include the PMB or # sign designation, The Mail Box Store of New Castle is not responsible for any piece of mail that is unable to be delivered due to improper addressing. The Customer is solely responsible for notifying correspondents of the proper address designation. The address to be used by Customer for the purpose of receiving mail available on the dashboard of the electronic portal.

8. Access: This is a Keyless PMB, therefore, possession of the mailbox username and password shall be considered valid evidence that the possessor is duly authorized to remove any contents from the mailbox. Access to Customer’s PMB will be provided during the business hours determined by The Mail Box Store of New Castle. Customer understands that the relationship between The Mail Box Store of New Castle and the Customer is one of bailment and not landlord tenant. In the event of death or incapacity of the customer, The Mail Box Store of New Castle will require the appropriate documents from the Probate Court, the executor of the estate, the trustee, or other similar person or entity before releasing mail or packages to a requesting party.

9. Delivery of Mail: Customer agrees to release and absolve the United States Postal Service (USPS) and its direct representatives from any and all liability or responsibility for mail that has been delivered to The Mail Box Store of New Castle by USPS personnel. All collection, distribution, handling, forwarding or other related services are hereto considered a separate, non-related transaction of business between the Customer and The Mail Box Store of New Castle. Once mail has been electronically assigned to the Customer’s PMB, the mail shall be deemed to have been delivered, and The Mail Box Store of New Castle shall not be responsible for loss, theft or damage. Completing a Pick Up of mail items for from the virtual PMB will require a signature to show that these have been received by the Customer. Customer may also be requested to show Identification. The Mail Box Store of New Castle is not engaged in the delivery of mail or other carrier shipments and cannot be responsible for failure of the United States Postal Service or other carriers to deliver mail or to deliver it in a timely fashion or in an undamaged condition.

10. Forwarding: USPS regulations require Customers to complete a new Form 1583 each time the official forwarding address for the mail is changed. The Mail Box Store of New Castle does not offer a Mail Forwarding service as part of the Mailbox Agreement. Customer designates that mail delivered to The Mail Box Store of New Castle by the USPS is considered delivered and any subsequent transactions involving physical or electronic forwarding or mail during the term of an active Mailbox Agreement is a separate non-related business transaction.

11. Payment/Fees: The Mail Box Store of New Castle’s fees are due and payable in advance and notice thereof will be placed in Customer's PMB and/or sent to Customer by email or text message. No other notice will be required. Failure to pay such fees when due may result in disruption or cancellation of services. The Mail Box Store of New Castle does not prorate fees for services not yet rendered and does not provide refunds in the event of cancellation by Customer or Termination with Cause by The Mail Box Store of New Castle. The Mail Box Store of New Castle reserves the right to assess fees for additional services, failure to adhere to requirements or failure to respond to attempts to gather USPS required information.

12. Failure to Pay: Failure to pay rent in advance by Customer will result in termination of mail services at which time Customer understands that per USPS regulation, The Mail Box Store of New Castle must continue to accept mail for Customer for a period of 180 days after termination. The Mail Box Store of New Castle will not make this mail available to Customer without payment in full for serves rendered. Customer will required to reach out directly to The Mail Box Store to make payment arrangements if their access to the online portal is cancelled. The Customer understands that the United States Postal Service will not forward or return mail without payment, and will not accept a Change of Address request. The customer agrees that mail delivered to The Mail Box Store of New Castle by the USPS is considered delivered and any subsequent transactions involving physical or electronic forwarding or mail during the term of an active Mailbox Agreement or the 180 day period following termination is a separate non-related business transaction.

13. Authorized Collector: Customer authorizes themselves as Authorized Collector of mail per USPS definitions. Should Customer appoint another person to collect mail or other shipments, it is the responsibility of the Customer to provide that individuals name and identifying documents to The Mail Box Store of New Castle for collection by the USPS. The Mail Box Store of New Castle shall will request notice from the Customer via email if an Authorized Collector is collecting mail items on their behalf and will treat this notice as authorization from the Customer and assume the Customer has supplied USPS required information for the designated Authorized Collector.

14. Residential/Personal Use Authorized recipients: The Customer understands that each additional individual or entity (authorized recipients) must complete a separate Form 1583 and provide the required forms of Identification to be authorized to receive mail or packages at the mailbox. The authorized recipient Form 1583 and required documentation must be completed before The Mail Service can accept mail or packages on their behalf. Minor children must be listed on Form 1583. Additional documentation may be required by The Mail Box Store of New Castle and must be made available upon request for any minors, disabled recipients, or individuals under a Power of Attorney (POA) or similar legal agreement. Mail for non-compliant individuals, without the required documentation completed with The Mail Box Store of New Castle will be marked as “Undeliverable” per US Postal Service Regulations and returned to sender.

15. Commercial/Business Use Authorized Recipients: All employees or business affiliates who will receive mail for a registered company must be listed on Form 1583 before The Mail Box Store of New Castle can accept mail on their behalf. Furthermore the company name is required to be included on all mail pieces for any employee or business affiliate without an executed Form 1583. Mail for unregistered companies, without the required documentation completed with The Mail Box Store of New Castle, or undocumented employees will be marked as “Undeliverable” per US Postal Service Regulations and returned to sender.

16. Services: See your current Service Plan to see plan details. Plan details subject to change, Customer will be notified at least 30 days prior to any changes or modifications to the current Service Plan. Customer is also bound by the terms of Anytime Mail Box. If terms differ Customer is bound by the stricter of the terms.

17. Limitations: If the Customer consistently receives substantially more mail than can be placed in the PMB, Mail Service reserves the right to require the Customer to rent a larger sized box or additional boxes. Charges for service are based upon average daily volume and activity. An unusually high volume of mail will result in either a higher fee being charged, or termination of the mail receiving service. The Customer further agrees that parcels delivered to this address for the Customer will be delivered by common carrier only, that no truck line deliveries will be made, that oversized parcels will be retrieved within 24 hours after delivery, and that no hazardous or dangerous materials will be delivered to Customer. Personal deliveries or deliveries without an established chain of custody will not be accepted. The Mail Box Store of New Castle reserves the right to charge additional fees for package receiving, handling, and storage. Failure to adhere to any of these parcel delivery stipulations may result in additional fees and/or termination of service.

18. Indemnity and Liability: Customer agrees to protect, indemnify and hold harmless The Mail Box Store of New Castle and their respective affiliates, subsidiaries, parent corporations, franchisees, officers, directors, agents, and employees from and against all losses, damages, expenses, claims, demands, liabilities, judgments, settlement amounts, costs and causes of action of every type and character arising out of or in connection with the use or possession of the mailbox, or use of The Mail Box Store of New Castle’s facilities or services, including without limitation, any demands, claims, and causes of action for personal injury or property damage arising from such use or possession, from the failure of the U.S. Postal Service or any commercial courier service to deliver on time or otherwise deliver any items (mail, packages, etc.), from damage to or loss of any package or mail, or to the mailbox contents by any cause whatsoever, and from any violation by customer of applicable federal, Republic or local laws. Should The Mail Box Store of New Castle commit or fail to commit any act which results in disruption of services and Customer thereby suffers a loss, The Mail Box Store of New Castle’s liability shall be limited to not more than the rental fees paid by Customer for services not yet received OR $100 whichever is less. The Mail Box Store of New Castle shall not be liable for any incidental, punitive, or consequential damages.

19. Confidentiality: This agreement, Form 1583, and any additional information provided by the Customer shall remain confidential, and will not knowingly be disclosed without Customers prior consent, except for postal operation purposes, or upon written request of any law enforcement or other governmental agency, or when legally mandated, in which case The Mail Box Store of New Castle intends to cooperate fully under the law.

20. Termination with Cause: Customer agrees that The Mail Box Store of New Castle may terminate or cancel this Agreement for good cause at any time by providing Customer with thirty (30) days written notice. Good cause shall include, but is not limited to 1) Customer abandons the mailbox; 2) Customer uses the mailbox for unlawful, illegitimate or fraudulent purposes; 3) Customer fails to pay monies owed when due; 4) Customer receives an unreasonable volume of mail or packages; 5) Customer engages in offensive, abusive or disruptive behavior toward other customers of The Mail Box Store of New Castle or The Mail Box Store of New Castle's employees; and 6) Customer violates any provision of this agreement. The customer acknowledges that to determine good cause for termination of this agreement as provided herein, the actions of any person authorized by the customer to use the mailbox will be attributed to the customer. For purposes of this Agreement, written notice shall be deemed to be received by Customer under one of the following conditions: (1) twenty four (24) hours after such notice is placed in Applicant’s mailbox; or (2) twenty four (24) hours after such notice is delivered to Applicant via email to the email provided by the customer. It is the responsibility of the Customer to ensure Customer contact information stays up to date for communication purposes. Repeated failures to adhere to USPS or The Mail Box Store of New Castle’s requirements will result in termination of services. Suspicious activity will be reported to USPIS in accordance with postal regulation and mail will be handled in accordance with instructions provided by USPIS during their investigation.

21. End of Term: Upon the conclusion of Agreement Term without renewal or cancellation of the mailbox by the Customer, the Customer Agrees not to submit a change of Address order with the USPS. It is the sole responsibility of Customer to notify correspondents of a change in receiving address prior to cancellation of Mail Service. The Mail Box Store of New Castle does not offer mail forwarding to Customers without an active and paid mailbox Agreement in place. In accordance with USPS DMM 508.1.8.3(b), Customer hereby releases The Mail Box Store of New Castle from its remail obligation upon the termination or expiration of this Agreement, or upon Applicant’s abandonment of the PMB. The Customer agrees to hold The Mail Box Store of New Castle harmless for any legal injury suffered due to the lack of mail that would have been remailed. The Customer agrees to release The Mail Box Store of New Castle from any remail requirement under USPS regulations and do so with the full understanding of the consequences. Further, The Customer understands that any mail later forwarded to the Customer or stored for the Customer by The Mail Box Store of New Castle will be considered a separate non-related business transaction and assessed remailing postage charges and/or storage fees as determined by The Mail Box Store of New Castle. This constitutes a “Do Not Forward” Agreement as per DMM 508.1.8.3.b. It is the customer's responsibility to make arrangements with The Mail Box Store of New Castle to identify any mail handling/storage needs before the expiration, cancellation, or termination of this agreement. If no arrangements are made within 10 days after of the date of cancellation, expiration or termination of this agreement, The Mail Box Store of New Castle reserves the right to discard and or destroy any mail that remains on premises and refuse further mail delivery. Upon conclusion of the agreement terms without renewal or cancellation of the mailbox by the Customer, The Mail Box Store of New Castle will a) retain customer any remaining customer mail for 10 days, if no arrangements are made, after such time any mail or packages may be discarded or destroyed, b) Discard or destroy any "Unsolicited Mail" (e.g., bulk mail; mail addressed as "occupant," "current resident" or similar designation; or coupons, advertising, or other promotional material) delivered to or remaining at The Mail Box Store of New Castle, c) Refuse any package addressed to the customer delivered by any party other than the U.S. Postal Service, such as a commercial courier service.

22. Duration: This Agreement shall be effective for the term stated above, provided that Customer has initially paid The Mail Box Store of New Castle all rent due in advance, and will also cover any renewal period paid for by the Customer from time to time. Renewal of this agreement for additional terms shall be at The Mail Box Store of New Castle’s sole discretion. The Terms of this Agreement extend to any individual or entity registered to the PMB listed in the agreement.

By agreeing below I forfeit all right to bring a suit against The Mail Box Store of New Castle for any reason. In return, I will receive the mailbox and related services. I will also make every effort to obey U.S. law and the laws of the State of Delaware, as listed in writing and as explained to me verbally. I will ask for clarification when needed.

The Customer agrees that by continuing to use the service, and checking the box below, you are agreeing to abide by the most recent version of these terms. This agreement, and any accompanying appendices, duplicates, or copies, constitute the entire agreement between the Parties concerning the subject matter of this agreement and supersedes all prior negotiations, agreements, representations, and understandings of any kind, whether written or oral, between the Parties, preceding the date of this agreement. If any provision or provisions of this agreement shall be held unenforceable for any reason, then such provision shall be modified to reflect the parties intention. All remaining provisions of this agreement shall remain in full force and effect for the duration of this agreement. This agreement shall not be assigned by either party without the express consent of the other party. A failure or delay in exercising any right, power, or privilege in respect of this agreement will not be presumed to operate as a waiver, and a single or partial exercise of any right, power, or privilege will not be presumed to preclude any subsequent or further exercise, of that right, power or privilege or the exercise of any other right, power or privilege. This agreement is governed by and construed following the laws of the State of Delaware without reference to any principles of conflicts of laws, which might cause the application of the laws of another Republic Admitted to the Union (the “United States of America”, or the “Union”). Territories and Protectorates of the Union are hereby discarded and no action may be taken within them against The Mail Box Store of New Castle. The laws of the State of Delaware shall supersede the United Nations Convention on Contracts for the International Sale of Goods (CISG) and all other United Nations laws. Any action instituted by either party arising out of this agreement will only be brought, tried, and resolved in the applicable federal or Republic Courts having jurisdiction in the State of Delaware

I HAVE READ THE ABOVE AGREEMENT AND UNDERSTAND ITS TERMS. I, HEREBY, KNOWINGLY AND VOLUNTARILY AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT AND CONSENTS TO THE EXCLUSIVE PERSONAL JURISDICTION AND VENUE OF COURTS HAVING JURISDICTION IN THE STATE.
